ChannelFix Universal Terms of Use Agreement

ChannelFix.com is a social-media platform to conduct vote-based online video tournaments. For purposes of this AGREEMENT, ChannelFix.com may also be referred to as ChannelFix, this website, the site, site, the Company or website.

By using ChannelFix.com, you agree to these conditions. Please read them carefully.

USER refers to all users of the Service, including users who are also contributors of Content, Viewers, Uploaders, Bloggers, Submitters, Posters, and all other Website Visitors of ChannelFix. “Content” includes the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials anyone may view on, access through or contribute to the Service.

  1. USE OF THE SITE. ACCEPTANCE OF THE TERMS AND CONDITIONS herein set forth is necessary in order to use the service. The moment USERS gain access to the site, CHANNELFIX presumes that USER has read, understood and agrees to the Site’s Terms and Conditions and Privacy Policy, which is incorporated by reference into this AGREEMENT.

    CHANNELFIX is constantly innovating for it to provide the best experience for its users. Thus, USER acknowledges that the form and nature of CHANNELFIX service and consequent thereto its TERMS and CONDITIONS may also change from time to time. Thus, any use of this SITE by USER after any amendments or modifications to these Terms and Conditions shall constitute acceptance of the most current version of these Terms and Conditions. Thus, USER must look at the TERMS regularly to check for changes. If USER does NOT AGREE to the Modified Terms and Conditions, USER must stop using the service. However, continued use of the Service after the posting of the Modified Terms and Conditions may constitute as acceptance on Modified Terms and Conditions.

  2. AGREEMENT IS A LEGALLY BINDING DOCUMENT. This AGREEMENT is a legally binding agreement between USER and CHANNELFIX in relation to USER’s use of the Service. It is important that USER takes the time to read this AGREEMENT carefully and abide hereto.

  3. CHANNELFIX ACCOUNT. In order to access some features of the Website or other elements of the Service, USER will have to create a ChannelFix account. When creating an account, USER must provide accurate and complete information. It is important that USER must keep his or her ChannelFix account password secure and confidential.

    By creating an account, USER can upload content, participate in the tournaments, express ones view, vote, blog and contribute to the content through text, graphics, sounds, music, photos, videos, audiovisual combination, interactive features and other materials analogous thereto.

    USER understands that videos uploaded in the SITE are public in nature for other USERS to vote for a tournament winner.

    USER must notify CHANNELFIX immediately of any breach of security or unauthorized use of one’s CHANNELFIX account or that the USER’s account has been compromised or has been accessed by a third party.

    USER agrees that he or she will be solely responsible to CHANNELFIX, and to any other person or entity for all activity that occurs under ones ChannelFix account regardless of whether the use of the account is authorized or unauthorized by the USER.

  4. GENERAL USE OF THE SERVICE PERMISSIONS AND RESTRICTIONS ON USE.

    CHANNELFIX hereby grants USER permission to access and use the Service as set forth in these Terms and Conditions, provided that:

    1. (A) The USER has limited authority to access and make personal use of the site. Thus, the site or any portion of the site should not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial or any other purpose. Downloading other than page caching, modification of the site or any portion of the content is PROHIBITED, EXCEPT with express written consent of CHANNELFIX, or in situations where CHANNELFIX itself makes available the means of distribution through a functionality expressly offered by CHANNELFIX;

    2. (B) The USER is not allowed to circumvent, disable or otherwise interfere with any security related features of the Site, the Service or any of its features that: (i) places any person or entity in a tournament to an advantageous or disadvantageous position, (ii) prevent or restrict use of Content, (iii) enforce any form of limitations on the use of the service or the content, (iv) changes the limitations set forth in the access or service of the SITE that disregards the limitations intended by CHANNELFIX;

    3. (C) The SITE has built-in anti-cheat systems. CHANNELFIX has the ability to immediately disqualify any tournament entry that is suspicious in nature after notice of the suspicious activity to the USER.

    4. (D) This SITE is for the personal use of the USER, thus, resale or commercial use of this site or its contents or any portion of the site such as but not limited to sale of access to the service, sale of advertising, sponsorship or promotions placed on or within the content or service, or the sale of advertising, sponsorship or promotions on any content delivered or uploaded in the site by the USER is prohibited unless if it is made with the written permission from CHANNELFIX;

    5. (E) USER agree not to solicit, for commercial purposes, from any USERS of the Website with respect to their Content WITHOUT CHANNELFIX written permission;

    6. (F) USER is not allowed to collect or harvest any personal data of any user of the SITE or any Service. Any collection and use of any product listings or descriptions, including any derivative use of this site or its contents, any downloading or copying of account information for the benefit of another merchant, or any use of data mining, robots, or similar data gathering and extraction tools are also prohibited.

    7. (G) User must not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CHANNELFIX and its associates without the written consent from CHANNELFIX. USER may not use any meta tags or any other “hidden text” utilizing the CHANNELFIX’s name or trademarks without the written consent of the CHANNELFIX.

    8. (H) USER is granted a limited, revocable, and nonexclusive right to create a hyperlink to the Site so long as the link does not portray CHANNELFIX, its associates, its USERS or their products or services in a false, misleading, derogatory, or otherwise offensive matter. USER should not use any the CHANNELFIX’s logo or other proprietary graphic or trademark as part of the link without express written consent from CHANNELFIX.

    9. (I) USER understands that throughout the tournament, participants are initially put into a list with all entries starting with 0 votes. Entries will move up the rankings based on voting received. At the conclusion of the RANKING stage, the videos that are in QUALIFYING position shall advance to the BATTLE stage wherein the videos are matched fairly through CHANNELFIX customized matchmaking system that has built-in anti-cheat algorithms. Being vote based the contestant who gets the highest number of votes win BATTLES and advance to subsequent rounds (if any.). CHANNELFIX or any of its employees and representatives will not indorse or promote any contestant to win. Thus, the contestants are expected to promote their uploaded videos to encourage more votes in their favor. In the event that there is a tie in the BATTLE stage, the higher seed from the RANKING stage shall advance. In the event there is a tie in the RANKING stage, the video that received the first vote shall advance or be seeded favorably.

    10. (J) USER is PROHIBITED to use CHANNELFIX for the purpose of negotiating, placing, receiving bets from any game of chance regardless of the form. Any person in the business of gambling or negotiating, placing and receiving bets is prohibited from using this SITE for such purpose. CHANNELFIX is NOT liable for any responsibility, accountability or damages that may be incurred as a result of this violation.

    11. (K) Employees of CHANNELFIX regardless of the status of employment and their relatives whether by affinity or consanguinity within the fourth civil degree that includes brothers or sisters, parents, grandparents, uncles or aunties, children, spouses and in laws of the same degree are prohibited to join or participate in any tournament in this SITE or to receive any Prize hereof. Such prohibition is effective until six (6) months after the employee is NO longer employed or is NO longer connected with CHANNELFIX.

  5. USER-GENERATED CONTENT PERMISSIONS AND RESTRICTIONS

    1. (A) By uploading a video in CHANNELFIX, USER warrants that he/she owns the video and that all persons reflected in the video authorized the upload of the video in the SITE. USER is prohibited in uploading videos or content owned by another person or reflects other persons apart from the USER without the other person’s permission.

    2. (B) USER agrees that in using the Services of CHANNELFIX, USER will not post any Content that contains (i) offers for any illegal activity; (ii) advocates any violence or intolerance of any specific individual, organization, ethnicity, race, creed, or belief; (iii) any misleading or inaccurate information with the intent of misleading other users; (iv) content that which may cause a liability to CHANNELFIX or its partner publications and websites (collectively referred as “PARTNERS”, for brevity), or may cause Company or any of its Partners to lose (in whole or in part) the services of any ISPs or suppliers; or (v) content that infringes upon the intellectual property or any other right of any entity or person including, but not limited to, copyrights and trademarks (vi) content that violates the rights of others specially that of a minor (below 18 years old) (vi) in cases where tournaments involved children or minors below 18 years old, the children should not be depicted in an offensive, scandalous or demeaning manner but should only uplift the morals, welfare and worth of the child;

    3. (C) USER shall not, through the Services, (i) impersonate any person or entity UNLESS the person or entity expressly consented thereto; (ii) harass any other USERS of the Site; and/or (iii) state or imply that any statement made by USER was endorsed by CHANNELFIX.

    4. (D) By using the website USER gave CHANNELFIX a nonexclusive, royalty-free, perpetual, irrevocable, and fully licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display any USER generated Content throughout the world in any media. USER grants CHANNELFIX and its licensees the right to use the name that USER submit in connection with such content, if the party so chooses. USER represents and warrants that USER owns or otherwise controls all of the rights to the content posts; and that the content is accurate.

    5. (E) USER further acknowledges that by submitting any content to CHANNELFIX, USER allows and grants CHANNELFIX including its authorized representatives and agents, authority to make use of such Content.

    6. (F) By submitting content to the Site, USER acknowledges that all the provisions in this TERMS AND CONDITIONS have been fully complied with by the USER. USER further acknowledges that by submitting a content to CHANNELFIX, USER allows and grants CHANNELFIX including its authorized representatives and agents to make use of such Content.

    7. (G) All right and title to the intellectual property in the user-generated content shall remain the property of the USER, and CHANNELFIX makes no claim to the rights in the content aside from those expressly granted in these terms. By uploading any user-generated content to the Site, USER grants CHANNELFIX a worldwide non-exclusive license to display such Content on the Site. USER may remove any user-generated content and revoke said license at any time unless USER maintains a negative balance on USER’s account, in which case, said balance has to be settled with CHANNELFIX prior to removing the user-generated content.

    8. (H) By using the SITE, USER acknowledges that all the provisions in this TERMS OF SERVICES have been fully complied with by the USER. Any violation of the Terms of Service may result to tournament disqualification, forfeiture of tokens and prizes, prohibition of site use and other liability as provided by law.

  6. THIRD PARTY DEVICES. USER agrees not to use any device, software or other instrumentality to interfere or attempt to interfere with the proper working of the Site, and that USER will not take any action that imposes an unreasonable or disproportionately large load on the SITE’s infrastructure. USER agrees not to use any robot, spider, other automatic device, or manual process to monitor or copy any content from the Site without the prior express consent from an authorized representative of CHANNELFIX, unless such use is by a search engine employed to direct Internet users to the Site.

  7. THIRD PARTY LINKS. There are links on the Site that lead to third party sites including those of advertisers. COMPANY IS NOT RESPONSIBLE FOR THE PRIVACY POLICIES OF THOSE SITES OR THE COOKIES THOSE SITES USE. IN ADDITION, BECAUSE COMPANY HAS NO CONTROL OVER SUCH SITES AND RESOURCES, USER ACKNOWLEDGES AND AGREES THAT COMPANY IS NOT RESPONSIBLE FOR THE AVAILABILITY OF SUCH EXTERNAL SITES OR RESOURCEES, AND DOES NOR ENDORSE AND IS NOT RESPONSIBLE OR LIABLE FOR ANY CONTENT, ADVERTISING, PRODUCTS OR OTHER MATERIALS ON OR AVAILABLE FROM SUCH SITES OR RESOURCES.

  8. TERMS OF SERVICE VS. SPECIFIC TOURNAMENTS MECHANICS. The tournament rules as incorporated in the Terms of Service apply to all the tournaments in the SITE unless stated otherwise in the specific tournament mechanics. Should there be any conflict between the Terms of Service and a specific tournaments mechanics, the terms of service must be followed.

  9. TOKENS. Tokens can be used to purchase CHANNELFIX products, increase the chances of winning in a tournament by trading it for voting power or it can be redeemed in its US dollar equivalent at the prevailing rate at the time of redemption.

    1. Earning tokens. The USER through any of the following may earn a token:
      1. Prize – Tokens may be a tournament prize in CHANNELFIX. USER can earn tokens by winning CHANNELFIX tournaments.
      2. Uploads – a USER will earn one (1) token for every video uploaded in the SITE.
      3. CHANNELFIX eLearning – CHANNELFIX eLearning is the official education arm of CHANNELFIX. USERS will earn 2 tokens after successfully completing educational or training modules from the SITE, ChanenlFix School 1, 2, 3, and 4.. This also includes viewing of advertisements from CHANNELFIX sponsors.
      4. Quantity Voting – A USER can earn tokens through quantity voting. A USER will earn (insert number of tokens) tokens for every one hundred (100) times USER votes in any tournament in the SITE;
      5. Referral System – By successfully referring at least ten (10) persons to the SITE, USER earns (insert number of tokens) tokens. The referred users must confirm and validate the message sent by ChannelFix for the referrer to earn tokens.
      6. Purchase of tokens – Tokens can also be purchased in the SITE in certain quantities to increase USER’S voting power or buying power for CHANNELFIX products.
    2. Redemption of tokens. Should USER choose to redeem his or her tokens, payment will be sent through PayPal subject to the following conditions:
      1. USERS can redeem a minimum of twenty-five (25) tokens at any given time;
      2. Tokens bought by a USER may be refunded only if the number of tokens bought is still intact. Token redemption for partially used tokens is NOT allowed;
      3. Tokens are nontransferable and can be used and redeemed only by its registered USER;/li>
      4. USERS should guard their respective CHANNEFLIX accounts. CHANNELFIX is not liable for lost tokens as a result of hacking or any unauthorized use by a third person.
      5. Should ChannelFix mistakenly credit a token to the USER’s account, ChannelFix remains to be the owner of such tokens and it will be automatically deducted from the User’s account upon discovery of the error.
  10. DISCLAIMER OF WARRANTIES. THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. USE OF THIS SITE AND OUR SERVICE IS AT USER’S SOLE RISK. COMPANY MAKES NO WARRANTIES, INCLUDING, BUT NOT LIMITED TO: (A) ANY IMPLIED WARRANTIES OF MECHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON INFRINGMENT; (B) THAT THE WEBSITE, OR THE SERVICES WILL MEET YOUR REQUIREMENTS; (C) THAT THE WEBSITE WILL BE SECURE, UNINTERRUPTED, ACCESSIBLE OR ERROR-FREE’ AND/OR (D) THAT ANY INFORMATION, DATA OR CONTENT OBTAINED FROM THE WEBSITE, OR THE SERVICE WILL BE ACCURATE, RELIABLE, COMPLETE, TIMELY OR FREE FROM VIRUSES OR OTHER FORMS OF DESTRUCTIVE CODE. NO ADVICE OR INFORMATION OBTAINED BY USER FROM US, WHETHER IN ORAL, WRITTEN OR ELECTRONIC FORM, RELATING TO YOUR USE OF THIS SITE, THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

  11. LIMITED LIABILITY. UNDER NO CIRCUMSTANCES SHALL CHANNELFIX BE LIABLE TO USER OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES FOR ANY MATTER ARISING FROM OR RELATING TO THIS AGREEMENT, THE SITE, THE SERVICES ANY CONTENT UPLOADED TO THE SITE BY USER, OR THE INTERNET GENERALLY INCLUDING, BUT NOT LIMITED TO: (A) THE USE OR INABILITY TO USE THE WEBSITE; (B) ANY CHANGES TO OR INACCESSIBILITY OF THE WEBSITE; (C) ANY DELAY, FAILURE, UNAUTHORIZED ACCESS TO OR ALTERATION OF ANY DATA OR ANY TRANSMISSION OF DATA;(D) ANY CONTENT OR DATA TRANSMITTED OR RECEIVED (OR NOT TRANSMITTED OR RECEIVED) BY/FROM YOU; AND/OR (E) ANY CONTENT OR DATA FROM A THIRD PERSON ACCESSED ON OR THROUGH THE WEBSITE, OR THE SERVICE; WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT OR OTHERWISE. SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMGES, THUS THIS LIMITATION OF LLIABILITY MAY NOT APPLY TO USER.

  12. INDEMNIFICATION. USER agrees to indemnify, hold harmless and defend CHANNELFIX, it’s directors, employees and agents from and against any action, cause, claim, damage, debt, demand or liability, including reasonable costs and attorney’s fees, asserted by any person or entity arising out of or relating to: (a) this Agreement and/or any breach or threatened breach by User; (b) User’s use of the Site, or the Services, including any data, content or material transmitted or received by User; (c) any unacceptable or objectionable use of the Site or the Services by User; and (d) any negligent or willful misconduct by User.

  13. INTELLECTUAL PROPERTY. Notwithstanding any USER rights in user-generated content, all content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of CHANNELFIX or its content suppliers and protected by International Copyright Laws. The Site may contain or reference trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes or other proprietary rights belonging to CHANNELFIX and/or other parties. No license to or right in any such trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes and other proprietary rights of CHANNELFIX and/or other parties is granted to or conferred upon USER.

    To notify CHANNELFIX of any copyright-infringing content, please contact us at dmca@channelfix.com with the following information in accordance with the Digital Millenium Copyright Act:

    1. Identification of the allegedly copyright-infringing material
    2. Identifying of the allegedly infringed-upon work and the copyright-holder of said work
    3. Information reasonably sufficient for Company to contact you
    4. A statement that you have a good faith belief that use of the material in the manner complaint of is not authorized by the copyright owner, its agent, or the law
    5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  14. UNAUTHORIZED USE. CHANNELFIX may monitor and edit or remove any activity or content that on its face violates this TERMS AND CONDITIONS, without necessarily informing the affected USER. CHANNELFIX further takes no responsibility and assumes no liability for any content posted by USER or any third party. CHANNELFIX shall, in its sole discretion, determine whether content fits any of the categories described herein and reserves the right to edit or delete any Content it deems to have violated the provisions of the Terms and Conditions. Any suspicious activity can also lead to immediate removal of content, ineligibility to join and participate in the tournament or suspension of accounts. Payout of prizes for winners can also be withheld to serve as a fine or payment for damages.

  15. DISPUTE RESOLUTION; BINDING ARBITRATION AND NO CLASS RELIEF

    If any USER has any grievance, dispute, claim, or any controversy against CHANNELFIX in line with its service, tournaments, interface, including the website, these Terms USER must first notify Channelfix in writing through channelfix.com. If Channelfix purportedly fails to address the grievance, claim or dispute within sixty days (60) from receipt of such written notice or complaint or in situations where the USER was dissatisfied with subsequent actions made by CHANNELFIX, its authorized representatives or agents, USER may proceed with the Arbitration Process stated herein.

    1. (A) Except with regard to the enforceability of the arbitration agreement contained herein, which shall be governed by the Federal Arbitration Act, this Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, as they are applied to agreements entered into and to be performed entirely without regard to conflict of law principles.

    2. (B) CHANNELFIX and USER herein agree to resolve disputes not through court or jury procedure but through arbitration on individual basis. Thus class relief is prohibited. Arbitration is more informal than lawsuit in court. Arbitration uses a neutral arbitrator to be elected by both CHANNELFIX and the USER or either of them with the subsequent approval of both CHANNELFIX and the USER. In this procedure, the Arbiter allows for more limited discovery than in court, and is subject to very limited review by courts. To reiterate, any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted.

    3. (C) Any dispute, claim or controversy arising out of or relating to the Service or use of the Service, including the website, any questions arising from or related to the tournaments, award of prizes, user interface, these Terms and Conditions and this Arbitration Agreement, and the Channelfix Privacy Policy, must be filed in Florida, USA within three (3) months from bargaining deadlock or failure to arrive at a decision with Channelfix after a written complaint has been submitted thereto. Failure to file within three (3) months will constitute as a waiver on a person’s right to purse any dispute, claim or controversy and the person’s right to file thereto shall be permanently barred.

    4. (D) This Arbitration Agreement is intended to be interpreted in a broad manner, including, but is not limited to:

      1. (i) claims arising out of or relating to any aspect of the relationship between CHANNELFIX and USERS, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory;

      2. (ii) claims that arose before this or any prior Agreement;

      3. (iii) claims that may arise after the termination of this Agreement.

    5. (E) USER agree that, by entering into this Agreement, USER and CHANNELFIX are each waiving the right to a trial in the courts, by jury or to participate in a class action. This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive termination of this Agreement.

    6. (F) A party who intends to seek arbitration must first send to the other by certified mail return receipt requested or by other mail delivery service that provides proof of deliver (e.g., FedEx), a written notice of dispute to:

    7. (G) The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by this Agreement, and will be administered by the AAA. The AAA Rules are available online at adr.org or by calling the AAA at 1-800-778-7879. The arbitrator is bound by the terms of this Agreement, including Disclaimer of Warranties and Limitation of Liability. The arbitrator shall have the right to award money damages and other appropriate relief, consistent with the terms of this agreement; HOWEVER THE ARBITRATOR SHALL NOT HAVE THE RIGHT TO AWARD INJUCTIVE RELIEF AGAINST EITHER PARTY OR TO CERTIFY A CLASS ACTION OF ANY KIND.

    8. (H) The venue of the Arbitration Proceeding shall be in St. Petersburg, Florida. All issues are for the arbitrator to decide. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based.

    9. (I) Each party shall be responsible for their own attorneys’ fees. Although under some laws CHANNELFIX may have a right to an award of attorneys’ fees and expenses if it prevails in an arbitration, CHANNELFIX agrees that it will seek such an award only in the event that the substance of your claim or the relief sought has been deemed by the arbitrator to be frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11 (b)).

    10. (J) USER AND CHANNELFIX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both USER and CHANNELFIX agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

    11. (K) If the waiver of the right to participate in a class action set forth in subparagraphs (b) and (d) above is found to be illegal or unenforceable for any reason whether by judicial, legislative, or other action, than the entirety of the agreement to arbitrate contained in paragraphs (b) and (d) is null and void. In that instance, USER and CHANNELFIX agree to waive the right to a jury trial. USER and CHANNELFIX further agree that any dispute, claim or controversy arising out of or relating to the Service or your use of the Service, including the website, user interface, and these Terms of Use shall be brought in the appropriate state or federal court located in St. Petersburg, Florida; and that we both irrevocably consent to the exclusive jurisdiction and venue of the state or federal courts in St. Petersburg, Florida.

  16. MISCELLANEOUS PROVISIONS:

    1. (A) PRIZES - CHANNELFIX shall NOT be responsible for prizes promised by other USERS who hold its tournaments through this SITE. For CHANNELFIX sponsored tournaments however, payment of cash prizes shall be in line with the process set forth by CHANNELFIX to accommodate its wide range of clients which may either be through one time payments or through installments on a case to case basis.

      Moreover, money transfer fees by authorized money transfer facilities such as PAYPAL, Western Union etc. shall be at the sole expense of the USER/Winner including shipping fees of the prizes.

      All prizes not claimed within the thirty (30) day period shall be considered forfeited and will become property of ChannelFix. ChannelFix may at its discretion, award the prize to another participant, either in the same contest, or at a later date and separate contest. Every attempt will be made to award all major contest prizes.

    2. (B) TAXATION - The USERS shall be responsible for taxation on their winnings or other taxable income or transactions that may be derive through the use of this SITE UNLESS otherwise provided in the tournament announcements.

    3. (C) ERRORS AND OMISSIONS. The Site may contain technical inaccuracies and typographical errors, including but not limited to inaccuracies relating to pricing or availability applicable to User’s transaction.   17. SEVERABILITY.
